​Full Terms and Conditions – A-Spec Suspension Subscription
1. Introduction

These Terms and Conditions (“Terms”) govern the subscription service (“Service”) provided by A-Spec Suspension (“we,” “us,” “our”) through our website. By subscribing, you enter into a legally binding 12-month contract and agree to comply with these Terms. If you do not agree, you must not subscribe or use the Service.

2. Definitions

Service: The recurring access to motorcycle suspension servicing, maintenance, or related benefits as described on our website.

Subscriber: Any individual or entity completing the subscription sign-up process and entering into a 12-month agreement.

Subscription Period: The fixed 12-month contract period running from 1 January to 31 December.

Renewal Date: The date your 12-month contract automatically renews (1 January each year) unless cancelled in writing prior to 1 January.

3. Scope of Service

The Service grants subscribers access to the agreed motorcycle suspension maintenance, servicing, or support benefits as outlined on our website or promotional materials.
We reserve the right to update or modify the scope of the Service at our discretion. Where significant changes are made, reasonable notice will be provided. No warranty, guarantee, or assurance is provided beyond what is expressly stated in these Terms.

4. Registration and Account

Subscribers must provide accurate registration details, including full motorcycle information (manufacturer, model, and frame number).
You are responsible for maintaining the confidentiality of your account credentials and must notify us immediately of any suspected unauthorised access.
We reserve the right to suspend or terminate accounts suspected of misuse, fraud, or dishonesty.

5. Sign-Up Period and Payment Schedule

Subscriptions can only be initiated between 1 October and 31 January each year.

Subscription payments commence on 31 January and are collected monthly until 31 December of the same calendar year.

All subscription fees are exclusive of VAT and other applicable taxes.

Non-payment may result in immediate suspension of the Service and debt recovery proceedings, including recovery of associated costs.

Current Subscription Fees:

Clubman: £23.00 per month

Expert: £45.00 per month

Factory: £75.00 per month

6. Contract Term and Cancellation

The A-Spec Suspension subscription is a 12-month fixed-term contract.

You may provide written notice of cancellation at any time during the year; however, such notice does not terminate the 12-month contractual obligation.

The contract will automatically renew for the next 12-month term unless written notice of cancellation is received before 1 January.

Early termination of the contract before the 12-month period ends will result in the following:

You will be billed for all services already used at the standard prices published on our website at the time of cancellation; and

An early cancellation fee equal to 35% of the remaining balance of the annual subscription fee will apply.

Fees already paid are non-refundable, even if the Service is not used.

7. Service Usage and Outstanding Charges

If you fail to complete your payment schedule or cancel before the end of your 12-month term, you remain liable for any outstanding balance, including applicable early-cancellation fees and charges for services already rendered.
Invoices are payable within 14 days, and overdue balances may incur interest and recovery costs.

8. Motorcycle Details and Fraud Prevention

Each subscription applies only to the motorcycle registered at sign-up.
You must notify us in writing if you change your motorcycle. We reserve the right to refuse coverage for any undeclared motorcycle.
Misrepresentation, fraudulent activity, or false claims will result in immediate termination and liability for associated costs.

9. Fair Usage Policy

Subscription benefits are based on normal servicing and tuning intervals. Unreasonable or excessive usage beyond standard limits may incur additional charges.
We reserve the right to limit, suspend, or terminate Service access if you breach this policy.

10. Use of Subcontractors

A-Spec Suspension may engage authorised subcontractors or partner workshops to deliver services.
All subcontractors are verified for quality, safety, and compliance. While reasonable care is taken in their selection, we are not liable for their acts or omissions beyond due diligence and oversight.

11. Limits of Service Use

Our products and services are intended for off-road and competition motorcycle use. Motorsport and off-road activities involve inherent risks.
You accept full responsibility for confirming the suitability of all parts and services for your intended use. We do not guarantee that our services will prevent mechanical failure or accidents.

12. Modifications, Suspension, and Price Changes

We may modify, suspend, or discontinue the Service where necessary. Subscription fees may increase annually on 1 January, reflecting inflation or market changes (e.g. cost of oils, seals, materials). Subscribers will receive at least 30 days’ notice of any change.

13. Limitation of Liability

To the fullest extent permitted by law:

All warranties, express or implied, relating to the Service are excluded.

We are not liable for indirect or consequential losses, including loss of profits, goodwill, or data.

Our total liability under these Terms shall not exceed the total subscription fees paid during the six (6) months preceding the incident.

Where subcontractors are used, our liability is limited to reasonable due diligence in their selection.

14. Indemnification

You agree to indemnify and hold harmless A-Spec Suspension, its directors, employees, and subcontractors from all claims, damages, and expenses (including legal fees) arising from:

Your use or misuse of the Service;

Your breach of these Terms;

Any negligent or wilful act or omission by you.

15. Force Majeure

We are not liable for delays or failures caused by circumstances beyond our control, including natural disasters, supply chain interruptions, strikes, pandemics, or government restrictions.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
